I. General Platform Legal

1. Acceptance of Terms

By using MayDay Passport, you agree to these Terms of Service. If you do not agree, please do not use the app.

2. Purpose of the App

MayDay Passport is an informational reference tool designed to help travelers access emergency contact numbers, embassy information, and crisis guidance. It is intended to supplement, not replace, professional emergency services.

3. Informational Use Disclaimer

All content provided by MayDay Passport — including emergency numbers, embassy details, country safety briefings, crisis guides, and travel advisories — is for general informational purposes only. This information should not be relied upon as a substitute for professional advice, official government guidance, or direct communication with local authorities.

4. Translation Disclaimer

MayDay Passport is available in multiple languages for your convenience. While we strive for accuracy in all translations, the English-language version of this application and its content shall be considered the authoritative and definitive version. In the event of any discrepancy between the English version and any translated version, the English version shall prevail. Translations are provided as-is and MayDay Passport makes no warranty regarding the accuracy, completeness, or reliability of any translated content.

5. Limitation of Liability and Governing Law

Limitation of Liability

To the fullest extent permitted by applicable law, MayDay Passport shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of the application, including travel disruptions, personal loss, or reliance on informational content provided within the platform.

The information provided within MayDay Passport is intended for general informational and preparedness purposes only and should not be considered legal, medical, or professional travel advice.

Governing Law

These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict of law principles.

Dispute Resolution

In the event of a dispute arising from the use of the platform, users agree to first attempt to resolve the matter through good-faith communication with MayDay Passport before pursuing formal legal action.

6. Independent Platform Notice

MayDay Passport operates as an independent platform. We are not affiliated with, endorsed by, or connected to any government agency, embassy, consulate, airline, insurance provider, or emergency service. References to third-party organizations are provided for informational convenience only.

7. Travel Advisor Connections

MayDay Passport may allow users to connect with a travel advisor through the use of an advisor code or similar feature. Travel advisors are independent third parties and are not employees, agents, or representatives of MayDay Passport. MayDay Passport does not verify, supervise, or control the services provided by any travel advisor.

Any communication, advice, travel arrangements, or assistance provided by a travel advisor is solely between the traveler and the advisor. MayDay Passport is not responsible for the actions, advice, services, or omissions of any travel advisor connected through the app.

By using the advisor connection feature, you acknowledge and agree that MayDay Passport bears no liability for any advisor interactions.

8. Subscriptions and Billing

MayDay Passport offers the following optional subscription plans:

Payment will be charged to your Apple ID account at confirmation of purchase. Subscription automatically renews unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

You can manage and cancel your subscriptions by going to your App Store account settings after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Prices are in US dollars and may vary by region. Subscription pricing is subject to change at MayDay Passport's discretion. Existing subscribers will be notified of any price changes in advance.

9. Notifications and Messaging

MayDay Passport may send push notifications for trip reminders, Safety Circle check-in prompts, SOS alerts, and advisor messages. You can enable or disable notifications at any time through the app settings or your device settings.

Message content is transmitted through our servers to facilitate delivery but is not used for advertising or shared with third parties.

11. Third-Party Links and Content

MayDay Passport provides links to third-party websites, including charitable organizations and official government visa and immigration portals, for your convenience and reference. These links do not imply endorsement by MayDay Passport.

We are not responsible for the accuracy, content, or availability of any linked third-party website. Visa and entry requirement information is provided as a starting point only. Always verify requirements directly with the relevant embassy or consulate for your nationality before traveling.

12. Account Deletion

You may delete your account at any time through the Profile screen in the app. Deleting your account will permanently remove all your data from our servers and your device, including your profile, trips, vault documents, emergency contacts, safety circles, and messages. This action cannot be undone.

If you have an active subscription, deleting your account does not automatically cancel your subscription. You must cancel your subscription through the App Store before or after deleting your account.

13. Account Suspension and Termination

MayDay Passport reserves the right to suspend, restrict, or terminate any user account — whether traveler or travel advisor — at its sole discretion, with or without cause, and with or without prior notice. Grounds for suspension or termination include, but are not limited to:

From time to time, MayDay Passport may offer access to pre-release features, beta versions, or early-access programs. Participation is provided "as is" and "as available," without any warranty. Features may change or be removed at MayDay Passport's discretion. MayDay Passport is not liable for any damages arising from participation in a Beta Program.

16. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the app constitutes acceptance of any changes. We will notify users of material changes through the app.


II. Traveler Terms

1. Emergency Services Disclaimer

IMPORTANT: MayDay Passport does not replace local emergency services (police, fire, ambulance). In a life-threatening emergency, always call local emergency services first.

Emergency numbers and embassy information are provided for reference and may not always be current. MayDay Passport makes no guarantee of accuracy, availability, or response time of any emergency service listed.

2. SOS Feature

The SOS feature sends alerts to your personally designated emergency contacts. MayDay Passport does not dispatch emergency services and is not connected to any 911, 112, or equivalent emergency dispatch system.

3. Crisis Guides and Safety Information

Country safety briefings and crisis guides are provided for general informational purposes only. While we strive to keep this content accurate and up to date, briefings may not reflect real-time conditions, recent policy changes, or evolving security situations. You should not rely solely on MayDay Passport briefings for travel safety decisions. Always consult official government travel advisories and local authorities for the most current information.

4. Safety Circle Usage

Safety Circles allow you to connect with fellow travelers or family members for mutual check-ins and group SOS alerts. You are responsible for managing your circle memberships and ensuring that all members have consented to participate. MayDay Passport does not monitor or moderate Safety Circle activity and is not liable for any actions taken by circle members.

5. Safety Vault

Documents and files stored in the Safety Vault are kept locally on your device. MayDay Passport is not responsible for data loss due to device failure, theft, loss, or app deletion. You are responsible for maintaining your own backups of important documents.

6. Traveler and Advisor Connection

You may connect with a travel advisor by entering their unique advisor code. This connection allows your advisor to view your trip details and send you messages through the app. You can disconnect from an advisor at any time. MayDay Passport does not verify advisor credentials and is not responsible for the quality or accuracy of any advice provided.

7. Responsibility for Travel Conditions

You are solely responsible for verifying travel conditions, entry requirements, visa regulations, and safety advisories for your destination. MayDay Passport provides general reference information but does not guarantee its accuracy or completeness. Always consult official government sources and your airline or travel provider before departing.

8. Medical Information

MayDay Passport allows you to voluntarily enter personal medical information such as blood type, allergies, medications, and medical conditions. This information is intended solely for your personal emergency reference and may be displayed on your Safety Card.

IMPORTANT: MayDay Passport is not a medical device, electronic health record system, or substitute for professional medical advice, diagnosis, or treatment. The medical information you enter is self-reported and is not verified by any healthcare professional.

Storing medical information in MayDay Passport does not create a doctor-patient, provider, or any other professional medical relationship. You are solely responsible for the accuracy and completeness of any medical information you enter.


III. Travel Advisor Terms

1. Travel Advisor Responsibility

As a travel advisor using MayDay Passport, you are responsible for the accuracy of any guidance you provide to your clients. MayDay Passport does not verify, endorse, or guarantee the quality of your services. You agree to act professionally, comply with all applicable laws and regulations, and maintain appropriate professional credentials as required by your jurisdiction.

Travel guidance provided within the app is compiled from publicly available resources and is intended for general informational purposes only. Advisors are responsible for verifying all information independently before sharing it with clients.

2. Platform Access and Use

Access to the Travel Advisor Dashboard is granted at the sole discretion of MayDay Passport. You may use the dashboard only for the purpose of managing client travel safety and communication. Any misuse, including unauthorized commercial activity, data harvesting, or conduct that violates these terms, may result in immediate suspension or revocation of access.

3. Travel Advisor Verification

MayDay Passport reserves the right to request verification of your professional credentials, business registration, or other documentation at any time. Failure to provide requested verification may result in suspension or termination of your advisor access. MayDay Passport may deny, suspend, or revoke advisor access at its sole discretion, with or without cause.

4. Advisor Dashboard and Traveler Privacy

Through the Advisor Dashboard, you may access limited client information including trip details, check-in activity, and messages. You do not have access to your clients' private account data, Safety Vault documents, emergency contacts, medical information, or financial details. You agree to treat all client information as confidential and to use it solely for the purpose of providing travel advisory services.

5. Advisor Client Communication

Communication with clients through MayDay Passport must be professional, relevant to travel safety, and compliant with all applicable laws. You may not use the messaging system for unsolicited marketing, spam, or any communication unrelated to your advisory services. MayDay Passport reserves the right to monitor messaging for policy compliance.

6. Advisor Connection Codes

Your advisor connection code is unique to your account. You are responsible for sharing it only with clients who have agreed to connect with you. You may not share, sell, or transfer your connection code to unauthorized parties. Misuse of connection codes may result in termination of your advisor access.

7. Dual User Role

If you use MayDay Passport as both a traveler and a travel advisor, the Traveler Terms apply to your use of traveler features and the Travel Advisor Terms apply to your use of advisor features. Both sets of terms apply simultaneously where applicable.

Travel advisors do not receive, process, or have access to any subscription payments made by travelers through MayDay Passport. All traveler subscription billing is managed exclusively by Apple App Store or Google Play Store. Advisor dashboard access is separate from and unrelated to traveler subscription tiers.
